TERMS AND CONDITIONS

Information on how to enter, and the terms applying to the rewards and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to food service businesses operating in Australia (each an “Eligible Business”). A ‘foodservice business’ is a business that serves food outside of a customer’s home including full-service restaurants and cafes, pubs or clubs, independent pizza restaurants, and independent Quick Service Restaurants (but excluding global chain quick service restaurant outlets). Authorised representatives for an Eligible Business must be 18 years or older (“Eligible Business Representative”).

Employees (and persons sharing the same household) of the Promoter and agencies associated with this promotion are not eligible to participate in the promotion or act as an Eligible Business Representative. The promotion starts at 12:01 am (SYD/ MEL time) on 7/10/24 and ends at 11:59 pm (SYD/MEL time) on 01/12/24 (“Promotional Period”).

In addition to their Eligible Business Representative, each Eligible Business authorises the Promoter’s staff to enter the promotion on the Eligible Business’s behalf.  To the fullest extent permitted by law, each Eligible Business agrees to hold the Promoter and the Promoter’s staff harmless for any error or omission (other than fraud or recklessness) in entering the promotion on the Eligible Business’s behalf.

Rewards

To be eligible to receive a Reward, an Eligible Business must, during the Promotional Period, purchase, in 1 transaction, a minimum of $200 across any Eligible Product carton categories, or a combination of them, from an authorised foodservice distributor (“Qualifying Transaction”), visit www.anchorfpseasonstreatings.com.au (“Website”), and make a claim. Qualifying Transactions can also be made via a tele sales representative, or via the Promoter’s staff through Turn-in Orders, who will input the information on the Website on behalf of the Eligible Business.

Following the Promoter’s verification of a Qualifying Transaction and claim, Eligible Businesses will be rewarded with a Digital Prepaid MasterCard (“Pre-paid Card”), subject to the total Reward Pool of $50,000. The value of the Reward will depend on the value of the Qualifying Transaction:

Spend between $200 and $299.99 in 1 transaction to receive a $25 Pre-paid Card.
Spend between $300 and $399.99 in 1 transaction to receive a $50 Pre-paid Card.
Spend $400 or more in 1 transaction to receive an $80 Pre-paid Card.

Rewards will be awarded on a ‘first-come, first-served’ basis until the total Reward Pool has been awarded or the end of the Promotional Period, whichever occurs first. Reward claimants will be notified by email or online message within 2 business days of the Promoter verifying their claim.


Prize Draw

In addition to the Rewards, up to a maximum of 1 Qualifying Transaction for each week (i.e., Monday to Sunday) during the Promotional Period per Eligible Business will be entered into a random draw (“Prize Draw”) using information supplied/used to claim a Reward. The Promoter will determine whether the Qualifying Transaction was made during a particular week, based on SYD/MEL local time and the date of purchase.

Qualifying Transactions that are entered in the Prize Draw will be divided into 5 groups based on the location of the Eligible Business as follows: NSW/ACT, VIC/TAS, QLD, WA and SA/NT (each a “State Group”).
There will be 1 prize drawn per State Group (“Prize”), for a total of 5 Prizes, each a Pre-paid Card with a value of $5,000 for a total Prize Pool of $25,000.

The Prize Draw will take place at RO Digital, 20-40 Meagher St, Chippendale NSW 2008 at 2.00 pm (SYD / MEL time) on 9/12/24. Prize winners will be drawn randomly. The first valid Qualifying Transaction drawn for each State Group will win a Prize.

Prize winners will be notified by email within two (2) business days of the Prize Draw, and their details (e.g. business name or first Initial, surname and postcode, as applicable) will be published on the Website on 16/12/24.
The Promoter may draw additional reserve entries and record them in order in case an invalid or ineligible entry is drawn, or a Prize is not taken by the date stipulated (“Reserve Winner”).

The Promoter’s decision is final, and no correspondence will be entered into.
Prizes will be awarded to the Eligible Business or Eligible Business Representative appearing on the winning entries.

General

Any ancillary costs associated with redeeming a Prize or Reward are not included. Any unused balance of a Digital Prepaid Mastercard will not be awarded as cash. The Digital Prepaid Mastercard is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 pursuant to license by Mastercard Asia/Pacific Pte. Ltd. Mastercard and the circle's design are registered trademarks of Mastercard International Incorporated. Redemption of the Pre-paid Card is subject to the standard terms and conditions, which can be found at https://thecardnetwork.com.au/pages/terms-conditions. Mastercard is not associated with and has not funded this promotion.

  • Eligible Businesses must retain a copy of the purchase receipt or invoice number (Proof of Purchase) to claim a Prize or Reward. Failure to produce the Proof of Purchase when requested by the Promoter may, in the absolute discretion of the Promoter, result in disqualification of related entries and the forfeiture of any right to a Prize or Reward. Proof of Purchase must clearly state the value, place, date, and time of purchase within the Promotional Period, but prior to a winning entry.

The Promoter reserves the right to verify the validity of entries and Eligible Businesses (including an Eligible Business’s representative’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any person who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct that may jeopardise the fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's rights to recover damages or other compensation from a person who breaches these Terms and Conditions are reserved.

If for any reason a winner does not take a Prize, Reward or element thereof by the time stipulated by the Promoter, then the Prize, Reward or element thereof will be forfeited and in the case of a Prize, will be subject to an unclaimed prize draw or awarded to a Reserve Winner.

If any Prize or Reward is unavailable, the Promoter, in its discretion, reserves the right to substitute it with a prize or reward of equal value subject to any written directions from a regulatory authority.

Prizes, Rewards or any unused portion of a Prize or Reward, are not transferable or exchangeable and cannot be taken as cash. The total Reward and Prize pool is $75,000 - $50,000 in Rewards and $5,000 per State Group in Prizes.

A draw for any unclaimed Prizes will, if necessary, take place on 10/2/25 at the same time and place as the original draws, subject to any direction from a regulatory authority. Winners, if any, will be notified by telephone and email within 2 business days of the draw and published (e.g. business name or first Initial, surname and postcode, as applicable) at the Website on 17/2/25.

Eligible Business Representatives will provide, and consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), the Promoter’s products or business generally.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion to (a) to disqualify any otherwise Eligible Business if that business or the Eligible Business’s Representative has breached these Terms and Conditions; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any applicable rights under similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for, and excludes all liability (including negligence), for any personal injury; any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of, or connected to the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in the value of Prizes or Rewards to that stated in these terms and conditions; (d) any tax liability incurred by any person, Eligible Business, Eligible Business’s Representative; or (e) receipt or use of a Prize or Reward.

The Promoter collects personal information regarding each Eligible Business and Eligible Business Representative ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at https://www.anchorfp.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business. The Privacy Policy also contains information about how an Eligible Business may opt out, access, update or correct their PI, how an Eligible Business may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the promoter. The promoter will not disclose PI to any entity outside of Australia.
